15 Days to Trial
After 42 months of waiting and delays by my Perp we finally have the trial in just 15 days. Maybe.
The stress is building day by day now. I am not sure how I would handle a Not Guilty verdict by the judge. Her decision I am told may take more than a month.
I am prepared for another delay actually. It won't surprise me if the accused fires his lawyer at the last minute or claims to be ill. It has been a ClusterFuck of staggering proportions. My Perp played the Crown Prosecutor and the Court to perfection. It appears he knew the threat of being locked up if he failed to appear was toothless (it was). We showed up (5 hour drive each time).
The process has taught me that the Canadian Justice system needs to overhaul itself. The Charter of Rights and Freedoms in Canada under Legal Rights states -
Treatment or punishment
12. Everyone has the right not to be subjected to any cruel and unusual treatment or punishment.
If the treatment I have received if not unusual it should be. It is without question cruel but then again I am not the accused and it seems Legal Rights in the Canadian Charter only protect the accused despite using the word EVERYONE.
It is only after living this nightmare do I now fully appreciate why some people simply don't report. It is not because they don't want to, it is because they can't take the torture of the process.
